Welcome to the website www.chiara.gr, which is the online retail store of the individual company Chiara (VAT number: EL153451079) based in Sp. Merkouri Str. 11634, Athens - Greece, telephone number +306946033916 and mailing address: sales-admin@chiara.gr (hereinafter referred to as "Chiara" or "COMPANY"). 

ATTENTION: The following Terms and Conditions apply to EU and other International customers except for Greeks and Cyprians.

The Customers from Greece and Cyprus are requested to change the site language and read the Terms and Conditions in their respective language (greek).

GENERAL & SHOPPING TERMS

1.1
These general terms and conditions (the “General Conditions”) apply when you as a consumer (the “Customer”) place an order via www.chiara.gr and related pages, (the “Site”). The agreement is concluded between you and The General Conditions are only applicable for Customers that are consumers. Any other "Terms and Conditions" are strictly excluded. Any user entering and trading or using the services of the online store (hereinafter referred to as the "Customer" or "User" respectively) consents and accepts unconditionally these terms, without any exception. If a User does not agree with these terms, he / she has to abstain from using the e-shop and from each transaction with it. To ensure that our Privacy Policy is compliant with current statutory requirements at all times, Chiara reserve the right to make amendments at any time. This also applies where the Privacy Policy needs to be amended to accommodate new or revised products or services.

1.2
The Customer must be minimum 18 years old to order via the Website. Chiara does not, in accordance with Greek law, accept any credit purchases to persons below 18 years of age. Chiara reserves the right to deny or change a Customer’s order (e.g. if the Customer has provided incorrect personal data and/or has any record for non-payment of debt).

1.3
Chiara shall have no liability in case products are sold out, nor for image or typographical errors on the Website, e.g. errors in the product description or technical specification, inaccurate prices and price adjustments (such as changed prices from suppliers, change in currencies) or incorrect information with regards to whether a product is in stock. Chiara is entitled to rectify any such errors and, at any time, to change or update the information. If an inaccurate price has been stated for a product ordered by the Customer, Chiara will naturally notify the Customer accordingly and await the Customer’s approval of the amended price prior to Chiara continuing with the order process. All images on the Website shall be considered solely as illustrations. Such illustrations do not guarantee to reproduce the amount of products the Customer will receive or the exact appearance, function or origin of the product. Chiara is not responsible for any information by third parties provided for on the Website.

1.4
The Website and all its content is owned by Chiara or its licensors. The information is protected by intellectual property and marketing legislation. This means that trademarks, company names, product names, images and graphics, design, layout and information about products, services and other content may not be copied or used without the prior written consent of Chiara.

2. CONTRACTS AND ORDERS

2.1
In order to place an order through the Website, the Customer must accept the General Terms and Conditions. By accepting the General Conditions, the Customer undertakes to comply with the General Conditions in its entirety and acknowledges that he/she has read the information on personal data and cookies and consents to the use according to Chiara’s Privacy Policy set below in this document.

2.2
A purchase agreement is concluded when Chiara has confirmed the Customer’s order and the Customer has received an order confirmation from Chiara via e-mail. Chiara encourages the Customer to save the order confirmation for any future contacts with the customer service regarding the order. The Customer is entitled to cancel its order up until it has been confirmed by Chiara. If the order is cancelled, Chiara will refund any payments the Customer or its pay - or debit/credit card company has made with regard to the order.

3. CUSTOMER DATA

3.1
When you visit Chiara.gr and conduct a purchase, Chiara processes your personal data in order to provide the best site possible for you and to complete the purchase agreement. You confirm that the information you entered is accurate and complete and that any inaccurate or incomplete information is your responsibility. Information regarding Chiara's processing of personal data can be found in Chiara's Privacy Policy.

3.2
The Customer undertakes to ensure that no one, except the Customer, uses the Customer’s log-in details. The Customer may not disclose its username or password to any person and shall ensure that any documentation with information about username and password is kept in such a way that unauthorized persons may not access the information. The Customer shall notify Chiara without delay if it may be suspected that any unauthorized person has obtained access to the Customer’s password. The Customer is responsible for all purchases made with the Customers log-in details if the Customer has not provided such notification.

3.3
If Chiara suspects that the Customer abuses its user account or its log-in details or otherwise violates the General Conditions, Chiara is entitled to block the Customer’s access to its user account.

4. PRICES, FEES AND PAYMENT

4.1
The prices stated on the Website apply to orders placed on the Website. All prices are presented in Euros and include VAT. The prices do not include payment - and shipping fees, which are given separately.

VAT is charged depending on the Customer's location if it is subjected to VAT or not as stated, according to the directive 2006/112/EC.

4.2
The Customer can pay for its purchase in the manner specified on the Website. Chiara is entitled to charge the Customer already in connection with the order, unless invoicing or any similar payment method has been selected by the Customer and approved by Chiara. Upon invoicing Chiara or its partners may obtain a third party credit report. In such a case you will be informed accordingly. Chiara reserves the right not to offer all payment methods at all times, alternatively change payment method if the payment method the Customer has selected does not work, for whichever reasons, at the time of fulfillment of the order.

5. SPECIAL OFFERS

Chiara may from time to time provide special offers on the Website which may have more favourable conditions than those set forth in these General Conditions, e.g. with regard to payment or extended right of withdrawal. Such conditions will apply for the duration of the special offer and for the specific products set forth by Chiara in connection therewith. Chiara reserves the right, at any time, to withdraw such special offers. Upon termination or withdrawal of a special offer, these General Conditions shall apply without any amendments. Any offers on specific products on the Website are valid only for a limited period of time and until products are sold out.

6. DELIVERY AND SHIPPING

6.1
Products in stock are normally delivered within the number of working days set forth on the Website. Unless otherwise agreed (e.g. in connection with reservation of products not in stock), delivery will be made no later than 30 working days after Chiara has confirmed the order in writing through the order confirmation.

6.2
The expected delivery time is set forth in the order confirmation, at the checkout and/or on the current product page on the Website. Unless otherwise expressly agreed and if a delivery is delayed for more than 30 working days and it is not due to you as Customer, you are entitled to cancel the purchase.

6.3
If any package shall be picked up at a specific delivery point as the head office, the Customer shall do so within the time specified in the notification. Packages shall normally be retrieved personally with valid identification and order number. The Customer will receive a notification of delivery stating when and where the package shall be picked-up or received. The notification will be made by e-mail. Chiara is entitled to charge the Customer a fee of €15 if the package is not retrieved.

7. RIGHT OF WITHDRAWAL

7.1
When purchasing products on the Website the Customer has a 14 day withdrawal period in accordance with applicable consumer protection legislation. This means that the Customer has the right to cancel any purchase by notifying Chiara accordingly within 14 days from when the Customer or its representative received the product ordered (withdrawal period).

 

7.2
The right of withdrawal does not apply to the following kind of products:

(a)
products made to the Customer’s specification or which otherwise has been given a clear personalised character;

(b)
products with broken seals which may not be returned due to health protection or hygiene reasons (e.g. underwear, swimwear and similar products).

7.3
By accepting the General Conditions, the Customer acknowledges and agrees that the right of withdrawal is not valid for any digital content delivered otherwise than by a tangible medium.

7.4
In connection with ordering a product for which the right of withdrawal does not apply, the Customer will receive clear information. If a product has been sealed, the Customer may not break the seal if the Customer wishes to utilize its right of withdrawal. The right of withdrawal ceases accordingly when the Customer breaks the seal. A seal shall also include any technical seal (e.g. serial number).

7.5
If the Customer wishes to withdraw a purchase, the Customer shall, prior to the expiry of the withdrawal period, send a clear message to Chiara through sales-admin@chiara.gr. The Customer shall provide its name, address and other relevant information, e.g. order reference, invoice number and the name of the product in the message.

7.6
If the Customer uses its right of withdrawal, the Customer shall pay for the return shipping costs and is responsible for the condition of the product after the Customer has received the product and during the return shipping. The product shall be returned within 14 days from the date when Chiara was notified of the withdrawal. The product shall be sent well packaged, in good condition and in its original box and/or packaging. Any returns shall be sent to Chiara in accordance with the methods the Customer prefers (or even through Chiara’s delivery partnership) and direction set forth on the Website and which you will be notified by email too. Depending on the destination, customers may be subject to additional charges in order to receive their package. Such charges include Customs & Duty charges, VAT/local taxes, etc. The aforementioned fees are the sole responsibility of the customer/buyer, even in case of forced return, i.e. prior to the parcel being delivered to the customer. If you require more information on this, please promptly contact our customer support team.

7.7
Chiara may at time offer returns free of charge for certain products. If return free of charge is applicable, this is set forth on the applicable page for the product on the Website.

7.8
When the Customer withdraws its purchase, (cancels an order) Chiara will refund the amount the Customer has paid for the product, including shipping costs. Any additional shipping costs due to the Customer choosing another delivery than the standard delivery offered by Chiara are exempted from refund. Upon return of part of an order, the shipping costs will not be refunded. Chiara is entitled to deduct an amount from the amount to be refunded, which corresponds to the depreciation in value of the product compared to the original value of the product, if and to the extent such depreciation in value is due to Customer having handled the product to a greater extent than necessary to determine its function or characteristics.

7.9
Chiara will pay back the amount without undue delay, however, no later than within 14 days from the date Chiara received the Customer notification of withdrawal. However, Chiara may delay repayment until Chiara has received the product or the Customer has provided proof that the product has been returned, e.g. by means of certificate of delivery. Repayment will be made to the Customer by the payment method chosen by the Customer, unless otherwise agreed or if there is any objection for such a repayment.

8. COMPLAINTS

About complaints Chiara complies with the guidelines provided by the National Board for Consumer Complaints or the corresponding authorities in other European countries. 9. LINKS

Chiara may provide links to other websites beyond the control of Chiara and websites beyond the control of Chiara may provide links to the Website. Even if Chiara attempts to ensure that Chiara only provides links to websites which applies similar personal data and security provisions pursuant to the Privacy Policy, Chiara is not responsible for any protection or confidentiality of information or personal data which the Customer provides on other websites. The Customer should be cautious and read the personal data provisions applicable to the actual website.

10. FORCE MAJEURE

Chiara is not liable for any delays caused by circumstances beyond Chiara’s control, e.g. general labour dispute, acts of war, fire, lightning, terrorist attacks, changed governmental orders, technical problems, defects in power- /tele-/computer communications or other communication and defects or delays in the service by sub-suppliers due to circumstances set forth above. Such circumstances shall result in relief from damages and other measures. If any such situation should arise, Chiara shall inform the Customer accordingly both at the beginning and the end of the period for the current situation. If the situation has lasted for more than two months, both the Customer and Chiara are entitled to terminate the purchase with immediate effect.

11. CHANGES TO THE GENERAL CONDITIONS

Chiara reserves the right to change these General Conditions at all times. Any changes to these General Conditions will be posted on the Website. Changes will become valid once the Customer has accepted the General Conditions (in connection with a new purchase or while browsing the Website), alternatively 30 days after Chiara has informed the Customer of the changes. However, Chiara recommends that the Customer regularly remains updated on the Website in order to become aware of any changes to the General Conditions.

12. SEVERABILITY

If any provision of this Agreement is held to be invalid or unenforceable by any competent court, authority or arbitral tribunal, the remainder of that provision and all other provisions will remain valid and enforceable to the fullest extent permitted by applicable law. Any provisions determined invalid or unenforceable will be substituted by relevant legal guidance and advice.

13. APPLICABLE LAW AND DISPUTE RESOLUTIONS

13.1
Any disputes shall primarily be settled by agreement after discussions with Chiara’s customer services.

13.2
If a dispute cannot be resolved through discussion with Chiara's customer service, you, as the customer, can directly submit complaints online via the EU-commissions platform mediation for disputes, which can be found at the following link here. If you submit a complaint via that platform, your submission will automatically be forwarded to the correct national body responsible for resolving disputes. That body will then contact us and try to resolve the dispute without court involvement.

13.3
Disputes concerning the interpretation or application of these General Terms shall be settled as determined under item 13.2, above, or ultimately by the courts.

 

Delivery Methods

ORDER DELIVERY

STANDARD Courier Delivery at home is estimated from 1 to 3 working days in Greece & Cyprus, 2-10 working days for Europe Custumers & 5-30 working days for International Customers: In this case the product is delivered to an external courier company and the Customer is informed by email that the product is ready for shipment. Shipping costs are calculated based on the Customer's order. Any erroneous registration on the part of the Customer and therefore wrong calculation of shipping costs is not responsibility of the COMPANY, but the Customer. 

PICK UP from the head office - Available only for customers that live in Greece. 

In case that the Customer chooses when submitting his order, picking it up from the head office will receive an electronic update of the estimated time of receipt of his order (Your order is ready to be received).  The Customer is required to receive the order within five calendar days of receipt of the relevant acknowledgment of receipt and upon agreement. If the Customer does not receive the product within five (5) calendar days of receipt of the notice to be received, the COMPANY reserves the right to withdraw from the sale. To receive the order, the Customer must show the order confirmation (order code) and the notice of receipt as well as an official identity document (such as an ID or passport). Since the receipt of the goods, the customer is obliged to check the goods he receives, as with his signature on receipt he confirms that he has correctly received the products of his order.

The delivery time of the products sold is specified in the order according to the availability, confirmed in the acceptance of the order by the COMPANY, and is no more than thirty (30) days from the time of the sale, unless it is agreed otherwise by the parties and is confirmed by e-mail.

Attention: For orders placed after 14:00, delivery days are calculated from the next business day.

Force majeure: Chiara is not responsible for delays in the execution of the order (including delivery) due to cases that can not be attributed to the Chiara's fault or due to force majeure. Therefore Chiara is entitled to extend the time of execution.

 2. PAYMENT METHODS

  • With any Debit or Credit Card, through PAYPAL, the safest platform worldwide, without any additional charge or commission for the Customer.  You don't need to have a paypal account. You can pay with Visa, Mastercard, American Express, Discover, Union Pay etc.

  • Deposit / transfer to a bank account (National Bank of Greece, Piraeus Bank, Eurobank, Viva Payments). 

  • Pay with your Paypal balance.

In case of payment by bank transfer, the Customer should confirm the method by adding a note to the order so the payment details will be sent by email to the Customer. Additional fees and charges for electronic transactions that arise (possibly from the use of a different bank account, etc.) are sole responsibility of the Customer.

IMPORTANT: At the moment of payoff, the order number and the name of the Customer are required as a reason for the correct transaction.

 

Any products delivered remain the property of the Chiara until the final, full and complete payment of the price to it.

Return & Refund Policy

The Customer may easily return the products that has purchased from the online store within 14 days of receipt. The Customer may deliver the products directly to Chiara (the address is mentioned in the first paragraph of the terms and conditions of use) or send them at his own expense to the address indicated on the transaction receipt. In any case for online orders, the Customer should, prior to returning the products, contact Chiara either by phone or by e-mail to replace the product. Particularly, the Customer has the right to return a product purchased from the online store under the following terms and conditions:

 

  • Within 14 (fourteen) calendar days of delivery or receipt of the product.

  • The Customer must return the product in the exact condition it was when received. In particular, the returned product should not have been used, not washed, should be in excellent condition, just before sale, in its original original packaging (box, nylon, foam, etc.) which should not have any tears/alterations or being damaged and with all the contents of the original packaging. In addition, in order to accept the return of the product, must be send back the original purchase receipt (retail receipt, invoice) by the person who originally purchased the product and whose details are shown on the purchase receipt.

  • The return of the item is accepted only if the Customer has previously paid out any expenses paid by Chiara for sending the product to him and the shipping costs for its return.

  • The Customer may choose its own shipping method or otherwise if the Customer wishes, Chiara may receive the returned product from the place of the Customer if it is replaced with another product. Upon receipt of the new order, the return of the previous product can be made to the same courier. In this case the Customer will be charged with the corresponding amount of the shipping costs only for the receipt of a new order and not for the return of the previous product.

  • In case of making a change with another product, the Customer must first contact Chiara and submit a new order with the new product of replacement, in the notes of which the Customer is obliged to indicate that the new order is about a refund / change along with the code of the previous order.

  • After an order cancellation, Chiara is obliged to reimburse the Customer for the price it has received.

  • The refund will be refunded to the Customer no later than fourteen (14) working days from the time Chiara has received proven knowledge through a written email or a signed declaration.

  • No delivery costs are refunded if the order has been fullfilled and sent with the courier or if the Customer has already received the order.

 

        Can not be returned:

  • Products that are not suitable for return, due to hygiene reasons (e.g. underwear, swimwear, stockings, etc.).

  • Products that have been used, washed or worn.

Claims due to defect or lack of matched property.

In the case of responsibility of the COMPANY for a real defect, the Customer has the right to:

(a) require, without charge, the repair or replacement of the product with another, unless such an action is impossible or requires disproportionate costs,

(b) request a reduction of the price, or

(c) withdraw from the sale, unless it is a non-material defect.

If the Customer chooses to correct or replace the product, Chiara must make a correction or replacement within a reasonable time.

In any case if the Customer finds a defectous product, should contact the online store immediately after delivery on the same day or the next working day on the email.

 

LIMITATED LIABILITY: THE COMPANY does not provide a guarantee, nor warrants protection for the suitability of a product sold for any particular purpose.

 

Privacy Policy/GDPR

SECURITY PROTOCOL

The Company recognizes the importance of the security of Personal Data, as well as electronic transactions, and has taken all the necessary measures, using the most modern and advanced methods, to ensure maximum security. All information, related to user's personal information, is kept confidential. The Site uses the Secure Sockets Layer certificate (SSL) for secure online trading. This encrypts all user's personal information, including the credit card number, user name and address, so that they can not be deciphered or changed during their transfer to the Internet.


SSL today is a global standard on the Internet to ensure proper encrypted communication between web sites and network users to securely transfer encrypted data between network users and web servers. An encrypted SSL communication requires all information sent between a User and a server to be encrypted by the shipping software and decrypted by the acceptance software in collaboration with a globally accepted certificate authority, thereby protecting personal information during transportation. According to this standard, the Company has to manage security-oriented transactions both in processes and in IT systems.

The new General Regulation (EU) 2016/679 of the European Parliament and of the Council "on the protection of individuals with regard to the processing of personal data and on the free movement of such data" has replaced Directive 95/46 / EC and the national legislation that incorporated it, Law 2472/1997. The new General Regulation (EU) 2016/679 does not deviate substantially from the general principles of the existing framework for the protection of personal data, but seeks to create a stricter institutional framework for the processing of personal data and consequently their protection.

 

The information we process about you varies slightly depending on whether you are an unregistered customer who is casually surfing and shopping or if you created an account and are thus a registered user. Below, you can read more as to what each category entails.

INFORMATION ABOUT YOU AS A CUSTOMER

To handle your orders and purchases, we require the following information about you;

  • Name

  • Address, phone number and e-mail

  • Date of birth (for some payment methods)

  • Payment information and payment history

  • Information about your order (for ex: order number, product(s), delivery address, and invoice)

We do this with the legal obligation for Completion of the Purchase Agreement; without which, we would be unable to complete our transaction with you. The information is saved for 36 months, from the time both delivery and payment have been processed, for the purpose of helping you with potential complaints and returns.

 

In order to customize our marketing for you, showing our products and deals on both our site and those of our partners, we require the following information about you:

  • IP

  • Data gathered by cookies and the like. For example, on which products you clicked and your shopping history

  • Order number

We do this with the legal obligation of processing in a way that is necessary to cater to both our and your legitimate interests by marketing our products to you for up to one year after your latest activity on our site. If you wish to receive our newsletter, access to a variety of deals, participate in customer surveys, provide feedback, or ask a question in our customer forum, we require the following information about you;

  • Name

  • E-mail

  • Information you personally provide (for ex: your views, feedback and the like)

We do this only upon receiving your consent during the providing of said information. Storage time can vary depending on the situation, but it always complies with the period of time specified during the giving of consent.

 

In order to prevent misuse of our services or avoid, prevent and investigate crimes against the Company, we require the following information;

  • Name

  • Address, phone number and e-mail

  • Payment information (such as the repeated use of invalid card numbers and the like)

  • Information about returns and deliveries

  • IP-number

  • Potential customer notes

  • Customer service history

This use is necessary because we have an invested interest in preventing misuse of our services and avoiding, preventing and investigating crimes against the Company. Such information is saved as long as it is relevant in relation to the circumstance in question, but rarely exceeds upwards of 36 months.

 

In order to analyze, develop and improve our services, products and system , we require the following information about you;

  • Purchasing and user-generated data, such as click and hit history

  • Technical data surrounding devices and their settings (for ex: language, IP-address, web browser settings, time zone, operating system, and platform).

  • Information regarding how you interact with us. For example how you use the site, login method, where and how long you visit certain pages, response times, error codes, how you arrive to and leave the service, etc.

We do this with the obligation of processing in a way that is necessary to cater to both our and your legitimate interests by improving and developing our site, products and the offers we are able to provide. We do this through analysis on an aggregated level, ie that the analysis is general and not at an individual level.

By creating an account at Chiara and therefore registering as a member, you accept our General Terms and Conditions.

In order to fulfill our agreement with you as a member, we require the following information about you;

  • Name

  • Address, phone number and e-mail

  • Information and history regarding all your orders, such as order number, product(s), delivery address, invoice, etc.

  • Data gathered from cookies and the like. For example, on which products you click

We do this with the legal obligation to adhere to the membership agreement; without this information, we are unable to fulfill our agreement with you and offer the benefits your registration and account provide as established in the terms of the agreement.

Please observe that information such as your order history, use of the site and similar information are required in order for us, Chiara, to fulfill our agreement with you. As a result, the information is saved as long as you have an account, in accordance with the membership terms.

WHO CAN WE SHARE YOUR DATA WITH?

We sometimes share data, such as personal info, with various recipients in order to provide the services mentioned above. We never sell your information to anyone else without your approval. Potential recipients of your information are:

Delivery Service Providers

In order to fulfill the purposes of our processing of your personal information, we share your personal data with companies providing services to us, for ex: to process the sending and delivery of your items or providing certain systems. These companies can only process your personal information according to our explicit instructions and cannot use your information for any other reason.

Payment Service Providers

In order to manage payments via the site, we use various payment services. The payment service provider is responsible for their own handling of your personal information and has separate conditions which apply for them. Information regarding their conditions and handling of your personal data can be found when you choose which payment method to use on the site.

Collaborative Partners

In order to enable our partners to usher traffic to us via their channels, we provide information such as order numbers and purchase prices. The information is only shared for this purpose and is not sold or forwarded.

Other Recipients

We can send your data to other recipients, for ex: government organizations, if required of us by law. If all or a portion of our organization is shared or integrated with another organization, your personal data can be provided to our advisors, potential buyers and their advisors, and are passed on to the new owners of the business.

YOUR RIGHTS

You have a right to know which of your personal data we use. This can be provided through a process known as a registry extract. If you have an account, you can log in to My Account to see which data we have on you, for ex: contact information, your orders, your likes and comments on Chiara’s Blog etc. If you have not registered as a member or wish to receive a complete registry extract, you can contact our customer service and we will be glad to help you.

We want to ensure that your personal information is correct and up-to-date. With that in mind, you have the right to request the correction of inaccurate data about you. If the information you provided changes (for ex. if you change your e-mail address, name or payment information) or if you wish to delete your account, simply contact our customer service.

Regarding instances involving the ways in which we process your personal data through the consent provided by you, you always have the right (at any time) to withdraw your consent regarding that processing. You are also entitled to oppose some processing, for example direct marketing purposes and newsletters. In some circumstances, you even have the right to have your personal information deleted or blocked. This does not apply if we are required by law, for example, to preserve or otherwise process the information or if the information is required to fulfill an agreement with you.

COOKIES

We use so called cookies on Chiara’s Website. Cookies are small text files that are saved on your computer and our web server uses them to provide you with access to some of the functions available on the Website.
